Article 1 (Introduction)
These Terms of Service ("Terms") set forth the conditions for using QuickPSDViewer ("the App"). Users shall use the App in accordance with these Terms.
Article 2 (Provision of the App and Disclaimer)
The App is provided on an "as is" basis. The operator of the App ("the Operator") makes no warranties, express or implied, regarding the accuracy, completeness, safety, usefulness, fitness for a particular purpose, merchantability, non-infringement of third-party rights, or uninterrupted provision of the App.
The Operator shall not be liable for any damages incurred by users arising from the use of or inability to use the App, except where liability cannot be excluded under applicable law.
Even where the Operator bears liability for damages under applicable law, such liability shall, except in cases of willful misconduct or gross negligence on the part of the Operator, be limited to direct and ordinary damages actually incurred by the user.
Article 3 (User Responsibilities)
Users shall properly manage PSD files and other data handled with the App at their own responsibility and create necessary backups.
The Operator shall not be liable for any corruption, loss, alteration, or other issues with files or data arising from the use of the App, except where liability cannot be excluded under applicable law.
Article 4 (Advertising)
The App may display advertisements using Google AdMob or other ad serving services.
The Operator shall not be liable for the content of advertisements or for websites and services accessed through advertisements, except where liability cannot be excluded under applicable law.
For information on how Google AdMob handles data, please refer to the terms of service, privacy policy, and other provisions published by Google.
Article 5 (Intellectual Property Rights)
Copyrights and other intellectual property rights in the programs, designs, text, images, and other content constituting the App (excluding files and data that users load, display, or process using the App) belong to the Operator or to third parties with legitimate rights.
Rights in PSD files and other data that users load, display, or process using the App belong to the user or to third parties holding such rights. These rights shall not be transferred to the Operator through the use of the App.
Users shall use the App at their own responsibility to ensure that the files and data handled with the App do not infringe the copyrights, privacy, or other rights of third parties.
Adobe and Photoshop are trademarks or registered trademarks of Adobe Inc. in the United States and other countries.
The App is not provided, endorsed, sponsored, or supported by Adobe Inc., nor does it imply any affiliation with the company.
Article 6 (Prohibited Activities)
Users shall not engage in any of the following activities when using the App:
- Activities that violate laws, regulations, or public order and morals
- Activities that infringe the copyrights, trademark rights, privacy, or other rights or interests of the Operator or third parties
- Reverse engineering, decompiling, disassembling, analyzing, or modifying the App, except as permitted by law
- Reproducing, reprinting, selling, lending, or redistributing the App without the Operator's permission
- Activities that interfere or may interfere with the provision or operation of the App
- Using the App for fraudulent or illegal purposes
- Any other activities that the Operator reasonably deems inappropriate
Article 7 (Changes to the Terms)
The Operator may change these Terms in accordance with applicable law when any of the following applies:
- The change is in the general interest of users
- The change is not contrary to the purpose of these Terms and is reasonable in light of the necessity of the change, the appropriateness of the changed content, and other circumstances
When changing these Terms, the Operator shall notify users of the content of the change and its effective date by means deemed appropriate by the Operator, such as within the App, on the App's distribution page, or through other methods, by the effective date.
The revised Terms shall apply from the effective date set forth in the preceding paragraph.
For changes that require user consent under applicable law, the Operator shall separately obtain such consent.
Article 8 (Governing Law)
These Terms shall be governed by and construed in accordance with the laws of Japan.
